1. Acceptance of Terms
By scheduling, purchasing, or using any services provided by SafeAir Certified Mold Inspection Inc. (“SafeAir,” “we,” “us,” or “our”), you (“Client,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
These Terms and Conditions constitute a legally binding agreement between you and SafeAir. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.
2. Description of Services
SafeAir provides professional mold inspection, mold testing, and indoor air quality assessment services for residential and commercial properties. Our services include, but are not limited to:
- Mold inspection and visual assessment
- Air quality sampling and testing
- Surface sampling (swab and tape lift samples)
- Bulk sampling of materials
- Dust analysis
- Post-remediation clearance testing
- Thermal imaging inspection
All inspections are performed by Council-certified Microbial Consultants (CMC) through the American Council for Accredited Certification (ACAC).
3. Service Areas
SafeAir currently provides services throughout the state of Georgia, including but not limited to the greater Atlanta metropolitan area, and select areas of North Carolina. Service availability may vary by location. Please contact us to confirm service availability in your area.
4. Scheduling and Property Access
By scheduling an inspection, you represent and warrant that you have the legal authority to grant access to the property being inspected. You agree to provide our inspectors with safe, unobstructed access to all areas of the property that require inspection, including attics, crawl spaces, basements, and any areas where mold growth is suspected.
The Client or an authorized representative must be present during the inspection unless otherwise agreed upon in writing. SafeAir reserves the right to reschedule or cancel an appointment if safe access to the property cannot be provided.
5. Pricing and Payment
Service pricing is provided at the time of scheduling and is based on the scope of work, property size, and number of samples required. All prices are subject to change without notice.
Payment is due at the time of service unless other arrangements have been made in advance. We accept cash, check, and major credit cards. For commercial accounts, payment terms may be established upon approval of credit.
Additional charges may apply for rush services, weekend or after-hours appointments, travel to remote locations, or additional samples requested during the inspection.
6. Cancellation and Rescheduling Policy
Clients may cancel or reschedule appointments with at least 24 hours’ notice without penalty. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee equal to 50% of the scheduled service cost.
No-shows or same-day cancellations without prior notice may be charged the full service fee. SafeAir reserves the right to waive cancellation fees at its sole discretion.
7. Scope and Limitations of Services
Our inspections are limited to the visible and accessible areas of the property at the time of inspection. SafeAir does not perform destructive testing unless specifically requested and authorized by the Client in writing. Hidden mold behind walls, under flooring, or in other concealed areas may not be detected during a standard inspection.
SafeAir provides inspection and testing services only. We do not perform mold remediation, removal, or treatment. This separation ensures objectivity and eliminates any conflict of interest in our assessments.
Air and surface samples are collected according to industry-standard protocols and analyzed by accredited third-party laboratories. Results reflect conditions at the time and location of sampling and may not represent conditions throughout the entire property.
8. Reports and Results
Following the inspection and receipt of laboratory results, SafeAir will provide the Client with a written report detailing our findings, laboratory analysis results, and recommendations. Reports are typically delivered within 3-5 business days, depending on laboratory turnaround times.
The report is prepared for the exclusive use of the Client and should not be relied upon by third parties without SafeAir’s written consent. The report reflects conditions observed at the time of inspection and does not guarantee future conditions.
9. Health Disclaimer
SafeAir does not provide medical advice or diagnoses. While we can identify the presence and types of mold in your environment, we cannot determine the specific health effects that exposure may have on any individual. If you are experiencing health symptoms that you believe may be related to mold exposure, we recommend consulting with a qualified healthcare professional.
Our reports should not be used as the sole basis for medical decisions or treatment plans.
10. Limitation of Liability
To the fullest extent permitted by law, SafeAir’s total liability for any claims arising out of or related to our services shall not exceed the total amount paid by the Client for the specific service giving rise to the claim.
SafeAir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, regardless of whether such damages were foreseeable or whether SafeAir was advised of the possibility of such damages.
SafeAir is not responsible for any damages, losses, or costs arising from the Client’s failure to follow our recommendations, delays in addressing identified issues, or actions taken by third-party remediation companies.
11. Indemnification
The Client agrees to indemnify, defend, and hold harmless SafeAir, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the Client’s use of our services; (b) any breach of these Terms and Conditions; (c) any third-party claims related to the property inspected; or (d) the Client’s violation of any applicable laws or regulations.
12. Intellectual Property
All content, materials, methodologies, and reports produced by SafeAir are protected by intellectual property laws and remain the property of SafeAir. Clients are granted a limited, non-exclusive license to use reports for personal or internal business purposes only.
Reproduction, distribution, or publication of SafeAir’s reports, in whole or in part, for commercial purposes or public dissemination without prior written consent is strictly prohibited.
13. Privacy and Data Protection
SafeAir is committed to protecting your privacy. We collect, use, and store personal information only as necessary to provide our services and comply with legal obligations. Personal information may include your name, address, contact information, payment details, and inspection-related data.
We do not sell, rent, or share your personal information with third parties for marketing purposes. Information may be shared with accredited laboratories for sample analysis and with authorized personnel as necessary to perform our services.

14. Dispute Resolution
Any disputes arising out of or related to these Terms and Conditions or our services shall first be addressed through good-faith negotiations between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue mediation before initiating any legal proceedings.
Any legal action or proceeding arising out of these Terms and Conditions shall be brought exclusively in the state or federal courts located in Fulton County, Georgia, and the parties consent to the personal jurisdiction of such courts.
15. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
16. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with any service agreements, quotes, or invoices provided by SafeAir, constitute the entire agreement between the parties and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
SMS Messaging Terms
By opting in to receive SMS messages from SafeAir Certified Mold Inspection Inc., you agree to receive transactional and/or marketing text messages related to our services, appointments, promotions, and updates. Message frequency may vary.
Message and data rates may apply depending on your mobile carrier and plan. You can opt out of SMS communications at any time by replying STOP to any message. For assistance, reply HELP or contact us directly through our website.
Consent to receive SMS messages is not a condition of purchase. We reserve the right to modify or terminate our SMS messaging program at any time.
Age Restrictions
By using our website and opting in to receive communications from SafeAir Certified Mold Inspection Inc., you represent that you are at least 18 years of age or have the consent of a parent or legal guardian.
Our services and communications are not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that information has been collected from a minor without proper consent, we will take appropriate steps to delete such information.
